Bhutan Four Friends Tours and Travels

These Terms & Conditions govern the booking and use of tourism services provided by Bhutan Four Friends Tours and Travels (“Bhutan Four Friends”, “we”, “us”, or “our”), a Bhutan-based travel agency/tour operator.

By making an inquiry, booking a tour, making a payment, applying for a visa or permit through us, or travelling under an itinerary arranged by us, the traveller (“you”, “your”, or “traveller”) agrees to these Terms & Conditions.

These Terms are intended to operate in accordance with the applicable laws, regulations, policies, notifications, procedures and requirements of the Royal Government of Bhutan, including the requirements administered by the Department of Tourism and Department of Immigration, as applicable.

Where a mandatory Bhutanese law, regulation, government notification, or official tourism/immigration requirement differs from these Terms, the applicable government requirement shall prevail.


1. OUR TOURISM SERVICES

Bhutan Four Friends Tours and Travels arranges tourism services in Bhutan, which may include:

  • Bhutan tour packages;
  • Cultural and sightseeing tours;
  • Luxury and customized tours;
  • Family tours;
  • Honeymoon tours;
  • Trekking and hiking;
  • Adventure and outdoor activities;
  • Spiritual and wellness experiences;
  • Festival tours;
  • Transportation;
  • Hotel and accommodation arrangements;
  • Licensed guide services;
  • Visa and entry-permit assistance;
  • Sustainable Development Fee (SDF) assistance and processing where applicable;
  • Route permits and other travel documentation where applicable;
  • Airport transfers;
  • Domestic travel arrangements; and
  • Other tourism-related services.

The exact services included in a traveller’s booking will be stated in the applicable quotation, itinerary, invoice, booking confirmation, or service agreement.


2. BHUTAN’S RESPONSIBLE AND SUSTAINABLE TOURISM POLICY

Bhutan follows a distinctive tourism approach based on sustainable and responsible tourism.

Our tours are operated with respect for Bhutan’s:

  • Environment;
  • Cultural heritage;
  • Buddhist traditions;
  • Local communities;
  • Monuments and sacred places;
  • Wildlife and natural resources;
  • Local laws and regulations; and
  • Sustainable tourism objectives.

Travellers are expected to respect Bhutanese culture, customs, religious practices, local communities and the natural environment throughout their visit.

We may require travellers to comply with reasonable instructions from our guides, drivers, hotel representatives, local authorities and other authorized personnel.


3. GOVERNMENT TOURISM REQUIREMENTS

All tourism services provided in Bhutan are subject to applicable government laws, rules, regulations, policies, notifications and procedures.

Government requirements may change from time to time.

Such requirements may include rules concerning:

  • Tourist visas;
  • Entry permits;
  • Sustainable Development Fee;
  • Tourism services;
  • Certified accommodation;
  • Tourist guides;
  • Tourist vehicles;
  • Route permits;
  • Trekking;
  • Protected areas;
  • Monument and heritage-site access;
  • Border entry and exit;
  • Immigration;
  • Travel insurance; and
  • Other tourism-related matters.

We reserve the right to amend an itinerary or service where necessary to comply with an official government requirement.


4. SUSTAINABLE DEVELOPMENT FEE (SDF)

The Sustainable Development Fee (“SDF”) is a government tourism levy applicable to eligible visitors to Bhutan.

The applicable SDF is determined by the Royal Government of Bhutan and may vary according to:

  • Traveller nationality;
  • Age;
  • Applicable government concessions;
  • Length of stay;
  • Government incentives;
  • Exemptions;
  • Waivers; and
  • Other applicable government rules.

The SDF is not a fee determined by Bhutan Four Friends Tours and Travels.

Where applicable, the SDF must be paid in accordance with the procedures prescribed by the Bhutanese authorities.

The SDF amount quoted to a traveller may therefore be subject to change if the Government of Bhutan changes the applicable rate, concession, exemption, incentive or calculation method.

Where SDF is included in your package price, we will identify it in the quotation or invoice where reasonably practicable.

Where SDF is payable separately, the traveller remains responsible for payment.

The official government SDF requirements shall prevail over any information contained on our website or in previous quotations if the government changes the applicable rules.


5. VISA AND ENTRY PERMIT

Entry into Bhutan is subject to approval by the relevant Bhutanese authorities.

Depending on nationality and circumstances, travellers may require a:

  • Tourist visa;
  • e-Visa;
  • Entry permit;
  • Route permit; or
  • Other authorization.

We may assist eligible travellers with visa or permit applications when such assistance is included in the booking.

However, Bhutan Four Friends Tours and Travels does not guarantee that a visa, permit or entry authorization will be granted.

The final decision regarding admission to Bhutan rests with the competent government authorities.

The current Department of Immigration requirements include, among other things, a passport meeting the applicable validity requirement and other documentation specified by the authorities. 

Travellers are responsible for providing genuine, accurate and complete documents.


6. PASSPORT REQUIREMENTS

Travellers must possess a valid passport or other government-approved travel document as required by Bhutanese immigration authorities.

Travellers should ensure that their passport meets the applicable validity requirements for the intended journey.

The Department of Immigration currently states that a passport should have at least six months’ validity from the intended date of departure from Bhutan for tourist visa/permit processing. 

We strongly recommend that travellers check their passport validity well before booking and departure.

We are not responsible for consequences arising from:

  • Expired passports;
  • Incorrect passport details;
  • Lost passports;
  • Damaged passports;
  • Insufficient passport validity;
  • Failure to obtain required visas or permits; or
  • Incorrect or incomplete documentation supplied by the traveller.

7. TRAVEL INSURANCE

Travellers are strongly advised to obtain comprehensive travel insurance before travelling to Bhutan.

Insurance should, where appropriate, cover:

  • Medical treatment;
  • Emergency evacuation;
  • Repatriation;
  • Trip cancellation;
  • Trip interruption;
  • Lost or delayed baggage;
  • Personal belongings;
  • Travel delays;
  • Trekking and adventure activities; and
  • Other risks relevant to the itinerary.

Where travel insurance is required as part of an applicable government immigration or tourism requirement, the traveller must provide valid insurance documentation.

The Department of Immigration currently lists valid travel insurance among the requirements for tourist e-Visa/e-Permit applications. 


8. BOOKING AND CONFIRMATION

A booking request is not automatically a confirmed booking.

A booking becomes confirmed when:

  1. We have accepted the booking;
  2. The required deposit or payment has been received;
  3. Required documentation has been received; and
  4. We have issued written booking confirmation.

Availability of hotels, flights, vehicles, guides and other services is subject to confirmation.

A quotation or proposed itinerary does not guarantee availability until the booking has been confirmed.


9. TOUR QUOTATIONS

Our quotation will normally specify the services included in the proposed package.

Depending on the itinerary, the price may include:

  • Accommodation;
  • Meals where specified;
  • Transportation;
  • Licensed guide;
  • Sightseeing;
  • Entry fees where stated;
  • SDF where specifically stated;
  • Visa or permit processing where stated;
  • Airport transfers; and
  • Other services specifically listed in the quotation.

The following may be excluded unless expressly stated:

  • International flights;
  • Personal expenses;
  • Travel insurance;
  • Alcoholic beverages;
  • Laundry;
  • Telephone and internet charges;
  • Tips and gratuities;
  • Additional activities;
  • Additional accommodation;
  • Additional transportation;
  • Medical expenses;
  • Visa or government fees not included in the quotation;
  • Excess baggage;
  • Personal purchases; and
  • Other services not expressly listed as included.

10. GOVERNMENT FEES AND TAXES

Government fees, levies, permits, visa fees, monument fees, SDF, taxes and other mandatory charges may change.

Where such charges are imposed or increased after a quotation has been issued, the traveller may be responsible for the additional amount where permitted by applicable law.

We will make reasonable efforts to notify travellers of material changes affecting their booking.


11. PAYMENT TERMS

Payment requirements will be stated in the quotation or booking confirmation.

We may require:

  • An advance deposit;
  • Partial payment;
  • Full payment before arrival; or
  • Payment according to an agreed schedule.

A booking may not be confirmed until the required payment has been received.

If payment is not received by the stated deadline, we may cancel or release the booking and recover applicable cancellation or supplier charges.


12. CURRENCY AND BANK CHARGES

Prices may be quoted in USD, Bhutanese Ngultrum (BTN), Indian Rupees, or another currency agreed with the traveller.

Where payment is made in a different currency, the applicable exchange rate or payment-provider conversion rate may apply.

Bank charges, intermediary bank fees, card-processing charges or currency-conversion charges may be payable by the traveller unless otherwise stated.


13. CANCELLATION BY THE TRAVELLER

Cancellation requests must be submitted to us in writing.

Cancellation charges depend on:

  • The date of cancellation;
  • The tour booked;
  • Hotels involved;
  • Airlines;
  • Transportation;
  • Permits;
  • Government charges;
  • SDF arrangements;
  • Activity providers;
  • Non-refundable deposits; and
  • Other supplier terms.

The cancellation policy specifically stated in the traveller’s booking confirmation or invoice shall apply to that booking.

Where no specific cancellation schedule has been provided, refunds will be calculated after deducting amounts that are non-refundable or cannot reasonably be recovered from suppliers or authorities.

Government fees and other charges that are legally non-refundable may not be refundable.


14. SDF AND GOVERNMENT FEE REFUNDS

Any refund of SDF, visa fees, permits or other government charges is subject to the rules and decisions of the relevant government authority.

Bhutan Four Friends Tours and Travels cannot guarantee a refund of a government charge merely because a traveller cancels a tour.

Where a government authority refunds an amount to us on behalf of a traveller, we will pass on the applicable refundable amount after deducting any permitted transaction or administrative charges.


15. CANCELLATION BY BHUTAN FOUR FRIENDS

We may cancel or modify a tour where reasonably necessary because of:

  • Government instructions;
  • Changes in tourism regulations;
  • Immigration restrictions;
  • Road closures;
  • Severe weather;
  • Natural disasters;
  • Landslides;
  • Flooding;
  • Flight cancellations;
  • Safety concerns;
  • Supplier failure;
  • Political or civil disruption;
  • Public health emergencies;
  • Force majeure; or
  • Other circumstances outside our reasonable control.

Where reasonably possible, we will offer an alternative arrangement.

Any refund will be subject to amounts recoverable from suppliers and applicable government rules.


16. ITINERARY CHANGES

The itinerary provided at the time of booking is a planned itinerary.

The order of activities, sightseeing locations, hotels, routes or transportation may change because of:

  • Weather;
  • Road conditions;
  • Government restrictions;
  • Safety considerations;
  • Hotel availability;
  • Flight changes;
  • Local events;
  • Religious or cultural considerations;
  • Operational requirements; or
  • Other circumstances beyond our reasonable control.

We will make reasonable efforts to maintain the overall character and value of the tour.


17. ACCOMMODATION

Accommodation will be arranged according to the category stated in the confirmed itinerary.

Accommodation is subject to availability.

If the confirmed accommodation becomes unavailable, we may arrange alternative accommodation of a similar standard where reasonably possible.

Hotel facilities and services are operated by independent accommodation providers and may vary.

Special requests, including:

  • Specific room location;
  • Bed type;
  • Connecting rooms;
  • Early check-in;
  • Late check-out;
  • Mountain views; or
  • Other preferences

are subject to availability and are not guaranteed unless expressly confirmed in writing.


18. TOURISM-CERTIFIED ACCOMMODATION

Where applicable under Bhutanese tourism requirements, accommodation will be arranged through accommodation providers meeting the applicable government tourism requirements.

Government requirements regarding certified hotels or accommodation may change.

Where a government authority requires proof of accommodation for immigration, SDF, visa, permit or other purposes, travellers may be required to provide or retain the relevant documentation.


19. TOUR GUIDES

Where a guide is included in the package, the guide will provide services in accordance with the applicable Bhutanese tourism requirements and the itinerary.

Travellers must follow reasonable safety and operational instructions from the guide.

Guides may modify activities where necessary because of safety, weather, government instructions or other circumstances.


20. TRANSPORTATION

Transportation will be arranged according to the confirmed itinerary.

Vehicle type may depend on:

  • Group size;
  • Route;
  • Road conditions;
  • Weather;
  • Availability;
  • Safety requirements; and
  • Government requirements.

Drivers and vehicles may be provided by independent transportation providers.

Travellers must follow applicable safety requirements and reasonable instructions from drivers and guides.


21. TREKKING AND ADVENTURE TOURS

Trekking, hiking, camping, rafting, cycling, mountain travel and other adventure activities involve inherent risks.

Risks may include:

  • Altitude;
  • Extreme weather;
  • Snow;
  • Landslides;
  • Uneven terrain;
  • Slippery paths;
  • River crossings;
  • Remote locations;
  • Limited communications;
  • Delayed emergency assistance; and
  • Other natural or environmental hazards.

Travellers participate in such activities voluntarily and must comply with applicable safety instructions.

We may alter, postpone or cancel an activity where continuation would create an unreasonable safety risk.


22. ALTITUDE AND PHYSICAL FITNESS

Certain Bhutan itineraries involve high altitude or strenuous walking.

Travellers are responsible for determining whether they are physically fit for their selected itinerary.

Travellers should obtain appropriate medical advice before participating in high-altitude or physically demanding activities.

If a traveller becomes unwell or is unable to continue, we may modify the itinerary for safety reasons.

Additional costs resulting from medical evacuation, additional accommodation, transportation, guide services or other emergency arrangements may be payable by the traveller or their insurer, subject to applicable law.


23. HEALTH INFORMATION

Travellers should inform us in advance of any special requirements that may materially affect the safe provision of the tour, including mobility requirements or dietary restrictions.

We will treat such information appropriately and use it only as reasonably necessary to provide the requested service and meet applicable legal or safety requirements.

We cannot guarantee that every supplier will be able to accommodate every medical or dietary requirement.


24. RESPECT FOR BHUTANESE CULTURE

Travellers must respect Bhutan’s cultural and religious traditions.

Travellers should:

  • Dress appropriately at religious and cultural sites;
  • Follow instructions at monasteries, dzongs and sacred locations;
  • Avoid disturbing religious ceremonies;
  • Follow photography restrictions;
  • Respect monks, local residents and communities;
  • Avoid littering;
  • Avoid damaging cultural or natural heritage; and
  • Follow instructions issued by local authorities.

Certain religious and heritage sites may have restrictions on photography, clothing, access or behaviour.


25. ENVIRONMENTAL RESPONSIBILITY

Travellers are expected to follow responsible tourism practices.

You must not:

  • Litter;
  • Damage plants or wildlife;
  • Remove cultural or natural objects;
  • Pollute rivers or natural areas;
  • Damage trails;
  • Disturb wildlife; or
  • Engage in activities prohibited by Bhutanese law.

We reserve the right to require a traveller to compensate for damage caused by their intentional or negligent actions, where permitted by law.


26. PERSONAL CONDUCT

Travellers must comply with Bhutanese law.

We may terminate a traveller’s participation in a tour if the traveller:

  • Engages in unlawful conduct;
  • Endangers themselves or others;
  • Seriously disrupts the tour;
  • Harasses staff or other travellers;
  • Damages property;
  • Refuses reasonable safety instructions; or
  • Seriously violates local cultural or religious requirements.

No refund will necessarily be payable where a traveller is removed from a tour because of their serious misconduct, subject to applicable law.

Any costs associated with returning the traveller to their home country or arranging additional services may be the traveller’s responsibility.


27. ALCOHOL, DRUGS AND ILLEGAL ACTIVITIES

Travellers must comply with Bhutanese laws concerning alcohol, controlled substances, drugs, prohibited items and other illegal activities.

We will not knowingly facilitate illegal activities.

A traveller who engages in illegal conduct is responsible for the consequences arising from that conduct.


28. PERSONAL BELONGINGS

Travellers are responsible for their own:

  • Passport;
  • Money;
  • Mobile phone;
  • Camera;
  • Laptop;
  • Jewellery;
  • Luggage;
  • Travel documents; and
  • Other personal belongings.

We strongly recommend keeping valuable items secure and maintaining copies of important documents.


29. FLIGHTS

International and domestic flights, where included, are subject to the terms and conditions of the relevant airline.

Flight schedules may change without notice.

We are not responsible for losses resulting solely from:

  • Airline delays;
  • Airline cancellations;
  • Missed connections;
  • Schedule changes;
  • Weather-related flight disruption;
  • Baggage delays or loss; or
  • Airline operational decisions.

Where possible, we will assist travellers in communicating with the relevant airline.


30. FORCE MAJEURE

We are not responsible for failure or delay caused by circumstances beyond our reasonable control.

Force majeure may include:

  • Natural disasters;
  • Earthquakes;
  • Landslides;
  • Floods;
  • Severe weather;
  • War;
  • Terrorism;
  • Civil unrest;
  • Government action;
  • Border restrictions;
  • Epidemics or pandemics;
  • Strikes;
  • Road closures;
  • Flight disruption;
  • Infrastructure failure;
  • Power failure;
  • Communications failure; or
  • Other unforeseeable or unavoidable events.

In such circumstances, we will make reasonable efforts to assist travellers but cannot guarantee that all costs will be refundable.


31. THIRD-PARTY SERVICE PROVIDERS

Some services are provided by independent third parties, including:

  • Hotels;
  • Airlines;
  • Transport companies;
  • Restaurants;
  • Activity operators;
  • Trekking providers;
  • Guides; and
  • Other tourism suppliers.

Such suppliers may have their own terms and conditions.

We will exercise reasonable care in selecting and coordinating suppliers but cannot control every act or omission of an independent supplier.


32. LIABILITY

We undertake to provide our services with reasonable care and skill.

To the maximum extent permitted by Bhutanese law, we are not responsible for loss, injury, delay, expense or damage caused by circumstances outside our reasonable control or by the acts or omissions of independent suppliers.

Nothing in these Terms excludes or limits any liability that cannot legally be excluded or limited under applicable law.


33. TRAVEL DELAYS AND ADDITIONAL EXPENSES

Where a traveller incurs additional expenses due to circumstances outside our control, including flight disruption, road closures, weather or government restrictions, those expenses may be the responsibility of the traveller or their insurer.

We will make reasonable efforts to help travellers identify practical alternatives.


34. COMPLAINTS

If you have a complaint during your tour, please notify your guide or our office as soon as possible.

Early notification allows us a reasonable opportunity to correct the problem.

If the matter cannot be resolved during the trip, you should submit a written complaint after the tour with:

  • Booking reference;
  • Traveller’s name;
  • Travel dates;
  • Details of the complaint;
  • Relevant receipts or documents; and
  • Requested resolution.

We will review the complaint fairly and in accordance with applicable law and our contractual obligations.


35. REFUNDS

Where a refund is approved, we will process it according to the applicable booking conditions.

Refunds may be subject to:

  • Supplier cancellation charges;
  • Bank charges;
  • Payment-processing fees;
  • Non-refundable hotel charges;
  • Airline penalties;
  • Government fees;
  • Permit charges;
  • SDF rules; and
  • Other non-refundable costs.

Refunds of government fees are subject to the relevant government’s rules.


36. CHILDREN

Parents or legal guardians are responsible for children travelling under their booking.

Children may be subject to different government fee, SDF, visa or permit rules depending on their age and nationality.

Any government concession applicable to children will be applied according to the current government requirements.


37. INDIAN, BANGLADESHI AND MALDIVIAN TRAVELLERS

Travellers from regional countries may be subject to different visa, permit and tourism requirements from other international visitors.

Applicable requirements may include nationality-specific entry documentation, SDF rates, permits and other government procedures.

We will apply the requirements applicable at the time of travel.

Travellers must provide correct nationality and identification information.


38. OTHER INTERNATIONAL TRAVELLERS

Travellers from countries requiring a tourist visa must comply with Bhutan’s current visa requirements.

Where authorized, we may assist with the application process.

Visa approval remains subject to the decision of the Bhutanese authorities.

The current official Bhutan tourism portal provides visa information and states that eligible travellers may apply online or have applications submitted through an authorized tour operator or hotel. 


39. GOVERNMENT INSPECTIONS AND COMPLIANCE

Travellers acknowledge that Bhutanese tourism and immigration authorities may implement inspections, documentation checks, reporting requirements and other regulatory procedures.

Travellers must cooperate with lawful requests from government authorities.

We may be required to provide information to government authorities where legally required.


40. PRIVACY AND PERSONAL INFORMATION

We collect personal information necessary to provide tourism services.

This may include:

  • Name;
  • Passport information;
  • Nationality;
  • Date of birth;
  • Contact details;
  • Travel dates;
  • Flight details;
  • Visa or permit information;
  • Accommodation information; and
  • Other information required to arrange the trip.

Where necessary, we may share relevant information with:

  • Bhutanese government authorities;
  • Immigration authorities;
  • Hotels;
  • Airlines;
  • Transport providers;
  • Guides;
  • Activity operators;
  • Payment providers; and
  • Other suppliers involved in delivering the booked services.

Information will be handled in accordance with our Privacy Policy and applicable law.


41. WEBSITE CONTENT

We make reasonable efforts to keep our website information accurate.

However, tourism regulations, prices, SDF rates, visa requirements, hotel information, flight schedules and other travel conditions can change.

Website information should therefore be read together with the traveller’s confirmed quotation and booking documents.

Where there is a conflict between general website information and a mandatory government requirement, the current government requirement shall prevail.


42. INTELLECTUAL PROPERTY

All original content on our website, including:

  • Text;
  • Photographs;
  • Graphics;
  • Logos;
  • Designs;
  • Tour descriptions;
  • Itineraries; and
  • Other materials

is owned by or licensed to Bhutan Four Friends Tours and Travels unless otherwise stated.

No content may be copied, reproduced, republished or commercially used without prior written permission.


43. THIRD-PARTY LINKS

Our website may contain links to official government websites, airlines, hotels, payment providers or other third-party websites.

We do not control third-party websites and are not responsible for their content, availability, security or policies.


44. CHANGES TO TOURISM POLICY

Bhutanese tourism policy is subject to change by the Royal Government of Bhutan.

Changes may affect:

  • SDF;
  • Visa fees;
  • Entry requirements;
  • Tourism regulations;
  • Hotel requirements;
  • Permits;
  • Monument fees;
  • Trekking requirements;
  • Guide requirements;
  • Transportation requirements; and
  • Other tourism services.

If government policy changes after a booking has been made, we may need to modify the booking to comply with the new requirements.


45. GOVERNING LAW

These Terms & Conditions shall be governed by the applicable laws of the Kingdom of Bhutan.

Any dispute arising from these Terms or from services provided by Bhutan Four Friends Tours and Travels shall, where applicable, be dealt with through the appropriate dispute-resolution mechanism or competent authority in Bhutan.

Nothing in these Terms is intended to remove any mandatory legal rights available to a traveller under applicable law.


46. SEVERABILITY

If any provision of these Terms & Conditions is determined to be invalid or unenforceable, the remaining provisions shall continue to apply to the extent permitted by law.


47. AMENDMENTS TO THESE TERMS

We may update these Terms & Conditions from time to time to reflect:

  • Changes in Bhutanese tourism policy;
  • Government regulations;
  • Immigration requirements;
  • Changes to our services;
  • Legal requirements; or
  • Changes in our business practices.

The latest version published on our website will apply to future bookings.


48. ACCEPTANCE

By submitting a booking request, paying for a tour, accepting a quotation, or travelling under an itinerary arranged by Bhutan Four Friends Tours and Travels, you confirm that you have read and accepted these Terms & Conditions.

You further acknowledge that your trip is subject to the applicable laws, regulations and tourism requirements of the Kingdom of Bhutan.

IMPORTANT NOTICE TO TRAVELLERS

Bhutan Four Friends Tours and Travels operates its tours in accordance with applicable Bhutanese tourism and immigration requirements. Government policies, fees, SDF rates, visa requirements and other tourism regulations may change.

Travellers should always rely on the applicable government requirements and their confirmed booking documents.

Where a government rule conflicts with information previously published on our website, the current applicable government rule shall prevail.

A couple of important points

I deliberately did not put “USD 200” into this version. The 2022 Tourism Rules contain the older USD 200 figure, but the current official Bhutan tourism portal states USD 100/day for adults, with concessions, and the official visa page currently reflects that rate.

I also recommend keeping the wording “applicable SDF rate” rather than hard-coding the amount into your Terms & Conditions. That way, if the Royal Government changes the SDF, you don’t have to rewrite your legal terms immediately.

For your website, I would also create three separate pages alongside these Terms:
